The military system itself was broken: "In the US army you are cut down for being honest... but if you are a conceited brown nosing shit bag you will be allowed to do what ever you want, and you will be handed your higher rank... The system is wrong. I am ashamed to be an american. And the title of US soldier is just the lie of fools." The soldiers he actually admired were planning on leaving: "The US army is the biggest joke the world has to laugh at. It is the army of liars, backstabbers, fools, and bullies. The few good SGTs are getting out as soon as they can, and they are telling us privates to do the same."

In the second-to-last paragraph of the e-mail, Bowe wrote about his broader disgust with America's approach to the war – an effort, on the ground, that seemed to represent the exact opposite of the kind of concerted campaign to win the "hearts and minds" of average Afghans envisioned by counterinsurgency strategists. "I am sorry for everything here," Bowe told his parents. "These people need help, yet what they get is the most conceited country in the world telling them that they are nothing and that they are stupid, that they have no idea how to live." He then referred to what his parents believe may have been a formative, possibly traumatic event: seeing an Afghan child run over by an MRAP. "We don't even care when we hear each other talk about running their children down in the dirt streets with our armored trucks... We make fun of them in front of their faces, and laugh at them for not understanding we are insulting them."

Bowe concluded his e-mail with what, in another context, might read as a suicide note. "I am sorry for everything," he wrote. "The horror that is america is disgusting." Then he signed off with a final message to his mother and father. "There are a few more boxes coming to you guys," he said, referring to his uniform and books, which he had already packed up and shipped off. "Feel free to open them, and use them."

To celebrate the opening of this board, I would like to deliver a lesson in United States copyright law.

When a work is created, the creator is automatically granted copyright over the work; among the rights granted by copyright law to the creator is the right over control of derivative works (works that include major, copyright-protected elements of an original, previously-created first work). The copyright holder is generally allowed to authorize and/or prevent the creation and publication of derivative works. In specific cases of parody or satire, derivative works can be ruled as legal regardless of the copyright holder's wishes - otherwise, unless the copyright holder has specifically authorized a derivative work, said work is considered to be an illegally-produced derivative work under United States copyright law. Now, what does this have to do with us? Well, this board is going to be about the posting of pornographic artwork, and that means pornographic artwork of characters from copyrighted works will be posted. Sites like ours normally go nuts with DNP lists and kowtow to artists who specialize in pornographic content based on copyrighted works in order to keep their asses out of a legal fire.

That attitude ends here and now.

To any artist who draws pornographic artwork based on pre-existing copyrighted works: unless you can prove that you have control over the copyright of your unauthorized derivative works, then you have no right to claim ownership of copyright over those works. (Fair Use is a defense, not a right.) If you say that you own the copyright to a piece of Bayonetta porn, then I will say that Sega has more rights to say if the work can be posted online than you do, since it holds the copyright on Bayonetta. Sending us (or our host) a DMCA takedown notification based on the idea that you own the copyright to an unauthorized derivative work is technically sending a false DMCA notification, which is tantamount to committing perjury during a legal proceeding.

When it comes to these types of derivative works, we will only accept takedown notifications from the copyright holder of the original work (as their legal standing is much higher than the artist's) unless artists can present evidence of a legitimate legal ruling that has given them full control over the copyright of their derivative work. Any artist who takes issue with this is free to take it up with the United States government and get laws regarding derivative works altered. (This goes for artists who make this work freely available and for artists who hide these works behind a paywall.)

If an artist offers up a notification for an original/non-derivative work, we will certainly take it into actual consideration.
